ln these Conditions the word 'Company, Aerochocks, Aerochocks.com' shall mean the Seller of the Goods which are the subject of these Conditions or any person authorised to act on the Seller's behalf and the word ''Customer'' shall mean the Buyer of the Goods, or any person authorised to act on the Buyer's behalf.
We may at any time make changes to this site and the details displayed on it (including prices).
.UK - TERMS & CONDITIONS OF USE
1. Prices and Payment
The prices for goods displayed for sale on this site are as set out on the site, are Aerochocks UK prices and are Inclusive of VAT. Delivery will be charged in addition, and any such additional charges will be notified to you on application or on completion of an order, where they apply.
Aerochocks cannot accept your order until you have supplied payment details for it in full. Upon receipt of these details, we will confirm acceptance of your order by e-mail which will be sent to the e-mail address you provide on your order details. Whether or not you receive the e-mail, our acceptance of your order will create a legally binding contract between us. We reserve the right not to supply you at our discretion.
Credit and Debit Card Payments
All card payments are processed by Paypal Services.
2. Your right to cancel your order
You may cancel your Aerochocks order at any stage before the goods are dispatched to you, However we reserve the right to charge for any expenses incurred in the processing of your order .If you wish to cancel your order you can email us on firstname.lastname@example.org
In some cases we may be unable to prevent your order from being dispatched to you. In this case we will arrange for your order to be collected at your convenience (see our returns and refunds policy).
3. Our returns and refunds policy
If your goods are faulty or damaged on delivery we will exchange the product or issue a refund. Goods must be returned to the Company in original packaging (and without being installed or used and with all relevant parts and packaging intact) within 14 days of receipt by the buyer.
If you have ordered in error, subject to a restocking charge of not less than 10% of the value of the order we will issue a refund ( *exclusions apply). Goods must be returned to the Company in original packaging (and without being installed or used and with all relevant seals and enclosures intact) within 14 days of receipt by the buyer.
In all circumstances any action shall be subject to the buyer producing proof of purchase and returning goods carriage paid.
* Exclusions: Products made to specific requirements or non stock items specifically ordered are excluded.
This does not affect your statutory rights.
How To return items:
Email sales@Aerochocks.com They will explain the procedure for the return of the unwanted goods. Emails will be returned within 24 hours in most cases
We shall not be liable to you where performance of any of our obligations to you is prevented, frustrated or impeded by reason of acts of God, war and other hostilities, civil commotion, accident, strikes, lock outs, trade disputes, acts or restraints of Government, imposition or restrictions of imports or exports or any other cause not within the reasonable control of Aerochocks.
Please ensure that you have received and checked your order in full before arranging fitment or installation of parts as no liability will be accepted for any costs incurred.
If any part of these terms and conditions is found to be unenforceable as a matter of law, all other parts of these terms and conditions shall not be affected and shall remain in force.
We cannot guarantee that the appearance and/or colours of products shown on this site exactly reproduce the appearance and/or colours of the physical products themselves. All sizes quoted are approximate.
To the extent permitted by law, Aerochocks accepts no liability for any loss, damage or injury arising as a consequence of the advice provided.
These terms and conditions and any contract between us shall be governed by and construed in accordance with English law and the English Courts shall have jurisdiction over any disputes between us.
5.The Customer shall have the right to inspect purchased goods before delivery so as to be satisfied of their suitability for the Customer's purpose both as to design, manufacture and materials used. Accordingly no terms or condition, express or to be implied by law pursuant to the Sales of Goods Act 1893 or by any other enactment or otherwise, shall be applicable to the contract nor shall the Company be responsible to the Customer for consequential loss of any kind howsoever caused whether by virtue of any breach of these conditions or any negligent act or omission on the part of any servant or agent of the Company.
The Customer hereby agrees with the Company to indemnify the Company against any claim in respect of damage of property or death or bodily injury to any person arising out of the use of the goods supplied at any time alter the despatch of such goods to the Customer by the Company. The goods shall be deemed to have been despatched to the Customer at the time of delivery to any carrier by the Company's servants or agents for transmission to the Customer.
A) The Company guarantees the products for a period of 12 months from date of shipment against defects due to faulty materials or workmanship, providing that the products are installed and used according to manufacturer’s specifications and or written instructions, and are not subjected to unauthorised repairs or alterations.
B) The Company shall repair or replace such equipment (as described in clause 17a above) at their discretion.
C) All parts repaired or replaced under warranty shall be re-warranted for the unexpired portion of the warranty period.
D) Warranty is on a return-to-manufacturer basis, unless otherwise agreed.
E) Charges will be levied for cost of shipping and material handling for items returned that are subsequently found to be giving satisfactory operation within the manufacturers’ specifications. F) In any event the Company cannot accept any liability whatsoever for consequential loss or damage howsoever caused resulting from any defect or faulty part, as detailed under Consequential Losses in clause 11.
